Depending on your financial situation, you will probably either qualify for a Chapter 7 or Chapter 13 bankruptcy. Our office will conduct a Means Test, based on your income, to make that determination. You can read more about the Means Test here.
Please be advised that our office is currently only taking Chapter 7 cases. Should you qualify for Chapter 13 case, we will most likely refer you to another attorney. Chapter 7 is basic liquidation of an individual’s property for the purpose of repaying creditors and getting rid of any remaining debts. The bankruptcy process typically takes 90 days from the day the case is filed until the day you get your discharge. There will only be one hearing that you will have to attend, called a meeting of creditors, or 341 hearing.
