Within the last decade, the bankruptcy laws changed to make filing for bankruptcy more difficult in an effort to prevent consumers from filing for bankruptcy. In doing so, Congress made it harder for people to file bankruptcy to deter them from abusing the system. The bottom line is this.. almost every consumer and business owner can file for bankruptcy. In fact, the majority of people who file for bankruptcy end up doing so due to medical debt, job loss or as the result of a large financial loss. Unfortunately, most of our clients don’t end up filing bankruptcy until months or even years of struggling to pay off their debts. We understand that having to file bankruptcy is a very difficult choice and we would never judge anyone for having to make this decision.
When filing for Chapter 7 bankruptcy, you will generally not have to pay back your unsecured debt - such as credit cards, medical bills, returned checks and balances owing on repossessed or foreclosed items. Taxes, student loans and child support typically will not be forgiven.
